Delivery & Ownership:
Collection and Delivery
1. Delivery Acceptance Deadline
Unless otherwise agreed in writing, the Client must accept delivery within 4 calendar days after being notified that the Order is ready.
Orders not accepted within 4 days will incur a handling fee of 25% of the total order value, or the Order may be sold to cover pxrDesign’s costs.
2. Free Delivery Eligibility
Orders over R1600.00 ex. VAT, placed via a branding consultant and delivered to Cape Town, Johannesburg, Durban, or Pretoria within 3 to 5 business days qualify for free delivery.
Unbranded orders over R1000.00 incl. VAT to the same cities and timeframe also qualify, subject to package size and weight.
Regional deliveries or bulky items (e.g., boxes, hand sanitiser, bottled water) may incur additional surcharges and may not qualify.
Freight insurance is excluded from free delivery and is the Client’s responsibility.
3. Courier Delivery for Non-Qualifying Orders
For orders not qualifying for free delivery, pxrDesign will provide a courier quote.
Delivery will be arranged after the Client accepts and pays the courier fee.
4. Freight Insurance
If requested in writing, pxrDesign will arrange freight insurance once full payment for the insurance is made prior to dispatch.
5. Delivery Location and Accessibility
The delivery address must be easily accessible to the courier.
Drop-off will be at the front entrance unless otherwise agreed in writing.
6. Delivery Times and Liability
Delivery times are estimates only.
pxrDesign is not liable for late or failed deliveries, including consequential damages.
The Client fully indemnifies pxrDesign against related claims.
7. Client’s Responsibilities During Delivery
The Client must take reasonable steps to minimize loss or damage and protect rights against couriers or third parties.
The courier acts as the Client’s agent, regardless of who pays or instructs.
If delivery fails due to the Client’s actions (e.g., refusal, wrong address, unavailability), extra delivery costs for re-delivery will be invoiced immediately.
8. Reporting Issues on Delivery
Any reservations about the Goods or packaging must be reported to the courier by recorded delivery within 24 hours of receipt.
The Client must also provide pxrDesign with a copy of the report, including photos, within 24 hours.
Without such notice, Goods are deemed accepted in good order.
9. Inspection and Returns
The Client must inspect Goods upon delivery to verify specifications and quantity.
Returns or refusals are not allowed without prior written approval from pxrDesign.
If Goods do not meet specifications, the Client must notify pxrDesign in writing within 24 hours.
pxrDesign may replace or refund Goods at its discretion if returned undamaged.
10. Ownership and Risk
Ownership of Goods remains with pxrDesign until full payment, including related costs, is received.
Until paid, the Client may not sell, pledge, encumber, or remove Goods without pxrDesign’s written consent.
If third parties claim rights over the Goods, the Client must notify pxrDesign immediately.
pxrDesign may take legal action, including cancellation, repossession, or enforcing payment.
11. Delivery Schedule and Late Delivery
Unless a specific delivery date is agreed in writing, pxrDesign will deliver as Goods become available and may deliver in parts.
Delivery times are not essential terms, and the Client may not cancel Orders for late delivery.
pxrDesign is not liable for any damages resulting from delayed delivery.
Branding Of Products Not Supplied By PxrDesign
1. Liability for Client-Supplied Goods
pxrDesign will not be liable for any damage to Goods supplied by Clients, whether or not pxrDesign performs branding on those Goods.
2. Losses During Transit
pxrDesign will not be liable for losses during transit.
Breakages and missing Goods will be reported as soon as identified.
3. Lead Time Adjustments
Lead times may change after Goods are inspected at pxrDesign’s warehouse in Sandton (Lincorp Industrial Park).
4. Print Result Variations
pxrDesign is not liable for slight variations in print results caused by:
a) Texture of the item
b) Colour of the item
c) Nature of the artwork
5. Permanent Branding Requirement
Not all branding is permanent.
If permanent branding is required, the Client must state this in writing when placing the Order.
6. Pre-Production Sample Recommendation
It is highly recommended the Client allow time for a pre-production sample to be printed.
This sample serves as final approval before mass production.
Costs for the sample and delivery are for the Client’s account.
If the Client declines the sample, pxrDesign is not liable for any errors in mass production, including consequential damages.
7. Re-Packaging Costs
If re-packaging of Goods is required, whether requested or not, all associated costs are for the Client’s account.
